Article 1.

Applicability

1.1 These General Terms and Conditions apply to all offers, orders and agreements of Eco Concept Group.


1.2 Accepting an offer or placing an order implies that you accept the applicability of these Terms and Conditions.


1.3 The provisions of these Terms and Conditions can only be deviated from in writing, in which case the other provisions will remain in full force and effect.



1.4 All rights and claims, as stipulated in these Terms and Conditions and in any further agreements for the benefit of Eco Concept Group, are also stipulated for intermediaries and other third parties engaged by Eco Concept Group.

Article 2.

Offers/ Agreements

2.1 All offers of Eco Concept Group are without obligation and Eco Concept Group expressly reserves the right to change the prices, in particular when this is necessary on the basis of (legal) regulations. See also article 3.6.



2.2 An agreement is only concluded after acceptance of your order by Eco Concept Group. Eco Concept Group is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, Eco Concept Group will inform you within five (5) working days after receipt of the order.

Article 3.

Prices and payments

3.1 The prices stated for the products and services offered are in Euro, including VAT and excluding handling and shipping costs, any taxes or other levies, unless stated otherwise or agreed in writing.


3.2 Payment must be made without discount or compensation within ten (10) days after the invoice date if it concerns deliveries within the Netherlands, and within ten (10) days after the invoice date if it concerns deliveries outside the Netherlands, unless otherwise agreed in writing.


3.3 Payment can be made in advance or via iDEAL telebanking. When paying by bank or giro, the date of payment is the date of crediting the giro or bank account of Eco Concept Group.


3.4 If the payment term is exceeded, Eco Concept Group can determine whether or not the order will be canceled.



3.5 If the prices for the offered products and services increase in the period between the order and its execution, you are entitled to cancel the order or to dissolve the agreement within five (5) days after notification of the price increase by Eco Concept Group .

Article 4.

Delivery

4.1 The delivery times specified by Eco Concept Group, namely; for items that are in stock, a delivery time of 2 to 4 working days (within the Netherlands and Belgium) applies. For items that are not in stock, Eco Concept Group will inform you in good time and offer you the opportunity to dissolve the agreement or to agree a new delivery time with Eco Concept Group. In the event of dissolution of the agreement, amounts already paid will be refunded within 30 days.



4.2 The delivery of the products will take place at the place and time at which the products are ready for dispatch to you.

Article 5.

Retention of title

5.1 The ownership of the delivered products is only transferred if you have paid all that you owe to Eco Concept Group under any agreement. The risk with regard to the products is already transferred to you at the time of delivery.

Article 6.

Intellectual and industrial property rights

6.1 You must fully and unconditionally respect all intellectual and industrial property rights that rest on the products delivered by Eco Concept Group.


6.2 Eco Concept Group does not guarantee that the products delivered to you do not infringe any (unwritten) intellectual and/or industrial property rights of third parties.



Article 7.

Returns / Right of return

7.1 You have the obligation to examine whether the products comply with the agreement upon delivery. If this is not the case, you must notify Eco Concept Group of this as soon as possible and in any case within fourteen (14) days (including the weekend) after the delivery, at least after observation was reasonably possible, in writing/email and with reasons.


7.2 If it is demonstrated that the products do not comply with the agreement, Eco Concept Group has the choice to replace the products concerned with new products if they are returned, if in stock.


7.3 If you do not wish to purchase a product for whatever reason, you as a private individual have the right to return the product to Eco Concept Group within fourteen (14) days after delivery. The following conditions apply: the item must not be used and must be returned undamaged and complete in the original packaging. The costs for returns are for your account.

Article 8.

Guarantee

8.1 Eco Concept Group guarantees that the products to be delivered meet the usual requirements and standards that can be set and are free of any defects.


8.2 The guarantee referred to in paragraph 8.1 applies for a minimum period of 12 months.


8.3 If the goods to be delivered do not comply with this guarantee, Eco Concept Group will return the goods within a reasonable period of time after receipt thereof or, if return is not reasonably possible, written notification with regard to the defect by the buyer, at the option of Eco Concept Group. , replace or arrange for repair.


8.4 The warranty referred to in this regard does not apply if the defect has arisen as a result of injudicious or improper use or if, without written permission from Eco Concept Group, the buyer or third parties have made changes or tried to make changes to the product or have used it. for purposes for which this product is not intended.


8.5 In addition to these warranty provisions, statutory warranty provisions remain in force.

Article 9.

Orders / communication

9.1 For misunderstandings, mutilations, delays or improper transmission of orders and communications as a result of the use of the Internet or any other means of communication in the traffic between you and Eco Concept Group, or between Eco Concept Group and third parties, insofar as relating to the relationship between you and Eco Concept Group, Eco Concept Group is not liable, unless and insofar as there is intent or gross negligence on the part of Eco Concept Group.

Article 10.

Complaints and Disputes

10.1 Eco Concept Group has a sufficiently publicized complaints procedure and handles the complaint in accordance with this complaints procedure.


10.2 Complaints about the implementation of the agreement must be submitted fully and clearly described to Eco Concept Group within 7 days, after the consumer has discovered the defects.


10.3 Complaints submitted to Eco Concept Group will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, Eco Concept Group will reply within the period of 14 days with a notification of receipt and an indication when the consumer can expect a more detailed answer.


10.4 If the complaint cannot be resolved in mutual consultation, a dispute will arise that is subject to the dispute settlement procedure.

10.5 In case of complaints, a consumer must first turn to Eco Concept Group. If a solution is not yet reached, the consumer has the option to have his complaint handled by the independent disputes committee appointed by Stichting WebwinkelKeur, the decision of which is binding and both Eco Concept Group and the consumer agree to this binding decision. There are costs associated with submitting a dispute to this disputes committee, which must be paid by the consumer to the relevant committee. It is also possible to register complaints via the European ODR platform (http://ec.europa.eu/odr).


10.6 A complaint does not suspend the entrepreneur's obligations, unless the entrepreneur indicates otherwise in writing.


10.7 If a complaint is found to be well-founded by the entrepreneur, the entrepreneur will, at its discretion, replace or repair the delivered products free of charge.


10.8 Agreements between the entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law. Even if the consumer lives abroad.


10.9 The Vienna Sales Convention does not apply.

Article 11.

Force of the majority

11.1 Without prejudice to its other rights, Eco Concept Group has the right in the event of force majeure to suspend the execution of your order, or to dissolve the agreement without judicial intervention, at its own discretion, by notifying you of this in writing. parts and this without Eco Concept Group being obliged to pay any compensation, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness.


11.2 Force majeure is understood to mean any shortcoming that cannot be attributed to Eco Concept Group, because it is not due to its fault and is not for its account under the law, legal act or generally accepted standards.

Article 12.

Miscellaneous

12.1 If you provide Eco Concept Group with an address in writing, Eco Concept Group is entitled to send all orders to that address, unless you notify Eco Concept Group in writing of another address to which your orders should be sent.


12.2 If Eco Concept Group allows deviations from these Terms and Conditions, whether or not tacitly, for a short or longer period of time, this does not affect its right to demand immediate and strict compliance with these Terms and Conditions. You can never assert any rights based on the fact that Eco Concept Group applies these Conditions flexibly.


12.3 If one or more of the provisions of these Terms and Conditions or any other agreement with Eco Concept Group should conflict with any applicable legal provision, the relevant provision will lapse and will be replaced by a new one to be determined by Eco Concept Group. legally permissible comparable provision.



12.4 Eco Concept Group is authorized to use third parties for the execution of your order(s).

Article 13.

Applicable law and competent court

13.1 All rights, obligations, offers, orders and agreements to which these Conditions apply, as well as these Conditions, are exclusively governed by Dutch law.


13.2 All disputes between the parties will be submitted exclusively to the competent court in the Netherlands.

14.1 To any images or portions of images available on this website. Reproduction of prints or entire text portions of downloaded documents files / photography is strictly prohibited without the express permission of the author.
